1. About These Terms and the Operator
These Terms of Use govern your use of the DIE KebApp website, mobile application, and associated discovery, account, gamification, event, team, and community-related functions.
Operator
DIE KebApp is currently operated by Gbocho Alexandre David as a sole proprietorship (Einzelunternehmen) in Germany.
The formation of a civil-law partnership (Gesellschaft bürgerlichen Rechts – GbR) is currently undergoing the relevant administrative formalities. Once these formalities have been completed, Ahmed Abdelhamid Youns Zeid will join Gbocho Alexandre David as a partner in the GbR, which will then become the responsible operator of DIE KebApp.
Until this formal transition is complete, Gbocho Alexandre David remains the legal operator of DIE KebApp as a sole proprietor.
Further legal information is available in our Impressum.
These Terms apply when you create an account, use a function for which acceptance is requested, or otherwise use DIE KebApp.
Where account creation requires acceptance of these Terms, you must actively confirm that you have read and accept them. We may record the applicable Terms version and the time of acceptance.
2. What DIE KebApp Offers
DIE KebApp is a discovery, event, and gamification platform for local gastronomy and food culture.
DIE KebApp is currently in a limited public beta phase. During the beta phase, individual functions may be incomplete, may not always be available, and may be adapted in order to improve the service, correct errors, maintain security, comply with legal requirements, prevent misuse, or respond to technical or operational requirements.
Depending on availability, DIE KebApp may allow you to:
- Discover restaurants and local culinary offerings;
- View restaurant profiles, opening hours, events, and voluntary promotions;
- Create and manage a personal user account;
- Choose a pseudonym and, where available, create, join, or participate in a team;
- Collect XP, unlock badges, complete challenges, and progress through ranks;
- Participate in events and community activities;
- Use QR codes, reward codes, promotional codes, or event codes where available;
- Invite new users and receive referral XP where the relevant criteria are met; and
- Use location-based proximity search where you choose to enable location access.
We may further develop, adapt, pause, or discontinue functions where there is an objective reason, including technical improvement, security, fraud prevention, legal compliance, operational necessity, or where a function is no longer economically or technically reasonable to provide.
Where a change materially affects a core function available to you, we will provide appropriate notice where required by law. This does not affect statutory rights relating to digital products or other mandatory consumer rights.
DIE KebApp does not sell food, accept food orders, process payments for food, provide delivery services, accept reservations, or act as representative or agent of listed establishments.
Any order, purchase, reservation, or other agreement is made directly and exclusively between you and the respective establishment, outside DIE KebApp.
3. User Accounts
Certain functions require a user account.
When creating and using an account, you must:
- Provide accurate and complete information;
- Keep your login credentials confidential and protect them from unauthorised access;
- Inform us without undue delay if you suspect unauthorised use of your account;
- Maintain only one personal account unless we expressly allow an exception;
- Not create accounts under a false identity, by misrepresenting facts, or through automated scripts, bots, or other automated means;
- Not use another person’s account without their permission; and
- Not use your account to manipulate XP, promotions, events, QR codes, referrals, rankings, or other functions.
You are responsible for activity carried out through your account unless you are not responsible for unauthorised access and notify us without undue delay after becoming aware of it.
You may stop using DIE KebApp at any time and may request deletion of your account through the app settings. Information about account deletion and data processing is available in our Privacy Statement.
4. Pseudonyms and Team Names
DIE KebApp allows users to choose a pseudonym and, where available, create, join, or participate in a team using a team name.
A pseudonym or team name must be lawful, respectful, and must not infringe the rights of other persons or organisations.
In particular, pseudonyms and team names must not:
- Contain racist, discriminatory, hateful, antisemitic, extremist, threatening, harassing, defamatory, insulting, or otherwise unlawful content;
- Target, demean, exclude, threaten, or discriminate against an individual or group on the basis of race or ethnic origin, nationality, descent, religion or belief, disability, sex, gender, sexual orientation, age, or another protected characteristic;
- Contain content that may constitute incitement to hatred, violence, threats, or other criminal conduct;
- Infringe personality rights, name rights, trademarks, copyrights, or other rights of third parties;
- Impersonate or falsely suggest an affiliation with another person, restaurant, organisation, public authority, or DIE KebApp;
- Contain advertising, spam, fraudulent statements, misleading claims, or unauthorised commercial content;
- Contain personal data of another person without a lawful basis or their permission; or
- Be used to circumvent these Terms, evade enforcement measures, manipulate app functions, obtain unauthorised benefits, or conceal abusive or unlawful conduct.
We may use automated checks and human review to identify potentially prohibited pseudonyms and team names. Automated checks support moderation and do not replace human assessment where a decision requires consideration of the circumstances.
We may reject a pseudonym or team name before it is displayed. We may also require a user or team to change a name, restrict its visibility, remove it, restrict related functions, or take account-related measures where there are objective reasons to believe that the name:
- Violates these Terms of Use;
- Is unlawful or may infringe third-party rights;
- Creates a safety, security, fraud, or misuse risk;
- Is misleading, impersonating, or discriminatory; or
- Requires action to comply with a legal obligation or protect the integrity of DIE KebApp.
Where we take a measure affecting a pseudonym, team name, account, or access to a feature, we will normally inform the affected user of the measure and the main reasons for it.
You may request a review of a decision affecting your pseudonym, team name, account, or access to a feature by emailing kebapp030@gmail.com. Please include sufficient information for us to identify the relevant account, team, name, or decision.
We will review substantiated requests in a timely, diligent, non-discriminatory, and non-arbitrary manner.
Where we have a reasonable and documented basis to believe that a pseudonym, team name, or related conduct may constitute a serious breach of applicable law—including unlawful discrimination, threats, incitement to hatred, or other criminal conduct—we may preserve relevant information and report the matter to the competent authorities where legally permitted or required.
Any disclosure to an authority will be limited to the information necessary for the relevant legal purpose.
5. Permitted Use
You must use DIE KebApp lawfully, fairly, and respectfully.
You must not:
- Manipulate XP, ranks, leaderboards, challenges, promotions, QR codes, reward codes, event participation, referral programmes, or other platform functions;
- Create fake accounts or use multiple accounts to obtain unauthorised benefits;
- Copy, sell, transfer, duplicate, share, reproduce, or misuse personal QR codes, promotional codes, reward codes, or event codes;
- Use false information, bots, scripts, automated means, or technical manipulation to obtain XP, rewards, ranks, access, or other benefits;
- Access systems, data, accounts, APIs, interfaces, source code, or technical infrastructure without authorisation;
- Interfere with, disable, overload, disrupt, or impair DIE KebApp, its website, Firebase infrastructure, partner systems, or other users;
- Introduce malware, harmful code, security vulnerabilities, or attempts to bypass security measures;
- Collect information about other users, teams, restaurants, systems, or services through scraping, crawling, harvesting, reverse engineering, or automated means without our prior written permission;
- Use DIE KebApp for unauthorised commercial advertising, spam, affiliate marketing, solicitation, or commercial exploitation;
- Misrepresent a relationship with DIE KebApp, a participating business, or another user; or
- Use DIE KebApp in any manner that violates applicable law, third-party rights, these Terms, or the intended purpose of the service.
6. XP, Ranks, Badges, and Challenges
XP means Experience Points.
XP, ranks, badges, and challenges are digital community and gamification features that may be available through DIE KebApp.
XP may be awarded for eligible activities, including participation in challenges, events, invitations, QR-code validations, promotional activities, team activities, or other activities where these features are available and the stated conditions are met.
Unless expressly stated otherwise in separate promotion terms:
- XP, ranks, badges, and challenges are not money;
- They have no cash value;
- They cannot be paid out, sold, transferred, or exchanged for money; and
- They do not themselves create an entitlement to a discount, payment, bonus, reward, or other financial benefit.
Where a specific challenge, promotion, reward, or event offers a benefit, the separate terms displayed for that offer apply. These terms may state eligibility criteria, validity period, availability or quantity where limited, participating venue, redemption conditions, and relevant restrictions.
We may correct, lock, remove, or reset XP, ranks, badges, challenges, or rewards where objectively necessary to correct a technical error, prevent fraud or abuse, enforce these Terms, comply with law, or protect the security and integrity of the service.
We will not use this right arbitrarily or to withdraw a valid benefit that has already been expressly granted, except where legally justified.
7. Invitations and Referrals
If a referral feature is available, you may receive XP for inviting new users.
Referral XP is awarded only where the eligibility criteria displayed in DIE KebApp are met.
We may reject, revoke, correct, or reset referral XP where there are objective indications of fraudulent registration, self-referral, multiple-account use, bot use, false information, manipulation, or other misuse.
8. Events and Community Activities
DIE KebApp may organise, promote, or list events and community activities.
Participation in an event may be subject to separate terms, age requirements, venue rules, capacity limits, safety rules, registration requirements, or instructions from the relevant organiser or venue.
Events may be changed, postponed, relocated, or cancelled where there is an objective reason, including safety, weather, capacity, legal requirements, technical issues, venue decisions, or circumstances outside our reasonable control.
Participants must behave respectfully and comply with applicable law, venue rules, safety instructions, and reasonable instructions from event staff, the venue operator, or the DIE KebApp team.
9. Restaurant Information and External Links
DIE KebApp displays restaurant and local-food information, which may include names, addresses, opening hours, menus, events, promotions, rankings, and other information.
Restaurant information may change. We make reasonable efforts to keep information accurate and up to date, but we do not guarantee that all displayed information is complete, current, or error-free.
Before visiting a restaurant or relying on essential information, please verify important details directly with the relevant establishment.
When you use external services, including navigation or map providers, the terms and privacy notices of the respective provider apply.
10. Role of DIE KebApp and Listed Businesses
DIE KebApp is an information, discovery, event, and gamification platform.
DIE KebApp is not a food seller, delivery service, food-payment processor, reservation service, or booking agency for listed establishments.
Any order, purchase, booking, reservation, complaint about food or service, or other agreement is made solely and directly between you and the relevant establishment. DIE KebApp is not a party to those agreements.
Listed businesses are responsible for their own food, products, services, prices, opening hours, promotions, representations, legal information, contractual performance, and compliance with applicable law.
11. Allergens and Food Information
Where menus, ingredients, allergens, nutritional information, or dietary labels are displayed, this information originates from the respective establishment or another identified source.
DIE KebApp does not independently verify all food-law information and cannot guarantee that displayed information is complete, current, or suitable for your individual health requirements.
If you have an allergy, intolerance, medical condition, or dietary requirement, you must contact restaurant staff directly before ordering or eating. Information displayed in DIE KebApp must not be used as the sole basis for decisions involving health risks.
Nothing in this section limits liability where DIE KebApp is legally responsible for damage.
12. Voluntary Support
DIE KebApp may provide optional links to external support platforms, such as Patreon or PayPal.
Any payment is processed directly by the relevant payment service provider under that provider’s terms, privacy notice, and buyer-protection rules. DIE KebApp does not receive or store payment-card or bank-account details through these payment providers.
Unless expressly stated otherwise before payment, voluntary support is not a purchase of food, a reservation, a guaranteed app feature, a guaranteed reward, or a claim to permanent access to a particular feature.
Voluntary support is not described as a tax-deductible donation, and DIE KebApp does not issue donation receipts unless expressly stated otherwise in writing.
13. Promotions, Rewards, and QR Codes
Listed businesses may voluntarily offer promotions, rewards, or benefits to users through DIE KebApp.
Where a promotion or reward is available, the relevant information displayed in DIE KebApp or in separate promotion terms will state the essential conditions, including eligibility requirements, validity period, availability or quantity where limited, participating venue, redemption method, and relevant restrictions.
Unless expressly stated otherwise, promotional offers are subject to availability at the participating business.
Participating businesses are responsible for their own offers, prices, food, legal information, and fulfilment of any benefit they provide.
QR codes, promotional codes, reward codes, and event codes are personal and non-transferable unless the relevant offer expressly permits transfer. They may not be copied, sold, shared, reproduced, manipulated, or used for fraudulent purposes.
We may block, invalidate, or refuse a code where there are objective indications of misuse, technical error, fraud, or breach of these Terms. This does not affect mandatory statutory rights.
14. Account Deletion, Restriction, and Suspension
You may stop using DIE KebApp at any time. You may request deletion of your account through the app settings in accordance with our Privacy Statement.
We may restrict features, temporarily suspend an account, or terminate an account where there are objective reasons.
These include serious or repeated breaches of these Terms, attempted fraud, manipulation of XP, rewards, QR codes, promotions, events, referrals, or rankings, use of false or multiple accounts, security risks, legal obligations, or technically necessary measures to protect the integrity of the service.
Where we take such action, we will normally inform you of the measure and the relevant reasons, unless we are legally prevented from doing so or immediate action is necessary to address an urgent security, fraud, safety, or legal risk.
You may challenge an account restriction, suspension, termination, or a decision affecting a code, reward, XP balance, rank, team, or pseudonym by emailing kebapp030@gmail.com. Please include the relevant account, code, event, team, pseudonym, or decision information so that we can review your request.
We will review substantiated requests in a timely, diligent, non-discriminatory, and non-arbitrary manner.
15. Intellectual Property
The name DIE KebApp, logos, graphics, software, program code, databases, editorial content, rankings, design elements, and other materials made available by DIE KebApp are protected by copyright, trademark, database, and other applicable laws.
Subject to these Terms, users receive a limited, personal, non-exclusive, non-transferable, non-sublicensable right to use DIE KebApp for its intended private purpose.
You may not copy, reproduce, distribute, modify, publicly communicate, reverse engineer, decompile, extract, scrape, commercially exploit, or otherwise use protected materials except where expressly permitted by law or with our prior written permission.
Nothing in these Terms restricts mandatory rights that cannot lawfully be excluded.
16. Data Protection
Information about the processing of personal data is available in our Privacy Statement.
17. Liability
DIE KebApp is liable without limitation for damage caused intentionally or through gross negligence, for damage resulting from injury to life, body, or health, and in all other cases of mandatory statutory liability.
In the case of slight negligence, DIE KebApp is liable only for breach of essential contractual obligations. Essential contractual obligations are obligations whose fulfilment is necessary for the proper performance of the contract and on whose fulfilment users may regularly rely.
In such cases, liability is limited to foreseeable damage typical for this type of contract.
Otherwise, liability for slight negligence is excluded to the extent permitted by law.
DIE KebApp is not responsible for the independent services, products, food quality, ingredients, allergen information, prices, opening hours, availability, conduct, or contractual performance of listed restaurants, participating businesses, navigation providers, payment providers, or other third parties, unless DIE KebApp is legally responsible for the relevant damage.
Nothing in these Terms limits mandatory consumer rights or liability that cannot lawfully be excluded or limited.
18. Changes to These Terms
We may amend these Terms where necessary to reflect changes in law, regulatory requirements, security requirements, technical developments, changes to our service, or to correct errors or ambiguities.
We will not use this right to change the main contractual balance between you and DIE KebApp arbitrarily.
For changes that materially affect your rights or obligations, we will provide appropriate advance notice and, where legally required, request your active agreement before the amended Terms take effect.
For non-material changes that do not adversely affect you, we may publish the updated Terms with a new effective date.
If you do not agree to a material change that requires acceptance, you may stop using the affected feature or terminate your account before the change takes effect. Your statutory rights remain unaffected.
19. Applicable Law and Contact
German law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods, unless mandatory consumer-protection provisions of the country in which you have your habitual residence provide greater protection.
If you have questions about these Terms of Use, account restrictions, QR/reward decisions, team or pseudonym decisions, events, or promotions, please contact us at:
